Welcome to Blynkscale. By accessing our website or engaging our services, you agree to comply with and be bound by the following Terms & Conditions.
1. Scope and B2B Exclusivity
Blynkscale offers specialized digital infrastructure engineering, custom database management, automation pipelines, and web architecture.
• B2B Limitation: Our services are intended exclusively for business entities, professional content creators, and independent entrepreneurs acting in a commercial capacity. We do not provide services to consumers (B2C). Consequently, consumer protection laws and statutory consumer revocation rights do not apply to our engagements.
2. Service Provision and Contracts
A binding contract for services is only established when an explicit, written service agreement or statement of work (SOW) is signed by both Blynkscale and the Client. Any quotes, proposals, or estimates provided via our website or email are non-binding invitations to treat.
3. Limitation of Liability
Blynkscale designs robust, scalable technical architectures using elite third-party automation tools (such as Stripe, Whop, and cloud database providers).
• We cannot be held liable for any operational downtime, lost revenue, or system errors resulting from API changes, outages, or technical failures initiated by these third-party platforms.
• Our liability for any contractual breach is strictly limited to predictable, typically occurring damages and shall not exceed the total amount paid by the Client to Blynkscale under the specific engagement.
4. Intellectual Property
Unless otherwise agreed in writing, Blynkscale retains all intellectual property rights to custom code templates, generic automation loops, and baseline infrastructure frameworks developed during the project. The Client receives a non-exclusive, perpetual license to use the final integrated system for their specific business operations upon full payment of all agreed fees.
5. Governing Law and Jurisdiction
These Terms & Conditions and all relations between Blynkscale and its clients shall be governed exclusively by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising from or in connection with our services is Hamburg, Germany.
